Legal Question, Deceased Father On Birth Certificate?
My boyfriend was killed in a car accident when I was 10 weeks pregnant. His mother and I would both like his name to be used on the birth certificate. Can I put his name on the birth certificate if he passed away before birth?

Yes! Be sure to list the dad's name as your child is likely eligible for social security survivor benefits! BENEFITS ARE NOT AUTOMATIC; YOU MUST APPLY FOR THEM! You'll need the dad's birth certificate, social security card & certificate of death to file. Visit www.ssa.gov or call 1-800-771-121.

I'm sorry really sorry for your loss, and you can add the name of the father in the baby certificate as long as you have enough proves to proof to the justice he were the father, so you must need a dna simple for that, and then after the baby born you make the dna test and then you ask a judicial petition to have the right to use his names on the birth certificate. good lucky.

That one is not any problem at all. like if you don't use his name, whose name are you going to use? more to the point, if the baby is born, and an innocent person happen to ask of the babies father, whose name will you mention? is it not the death persons name? and if that is the case why cant you use his name on the birth certificate?

I am certain that you can, but it would be worth double checking this with the person in charge of the certificates. I really cannot see any problem with having his name on the certificate, and I am sure this has happened to others in the same situation so it seems silly that you cannot.
